Welcome to AZ Policy Chic (the “Site”), a blog operated by J Martin Insurance Agency LLC, an Arizona limited liability company (“Company,” “we,” “us,” or “our”). By accessing or using this Site, you (“User” or “you”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Site.

These Terms constitute a legally binding agreement between you and J Martin Insurance Agency LLC, governed by the laws of the State of Arizona, without regard to conflict-of-law principles. 8. Limitation of Liability

To the maximum extent permitted by Arizona law, J Martin Insurance Agency LLC, its members, managers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of or inability to use the site or its content.

This includes, without limitation, damages for loss of profits, loss of data, loss of goodwill, business interruption, or any other intangible losses, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising from or related to the Site exceed the greater of (a) one hundred U.S. dollars ($100.00) or (b) the amount you paid us, if any, in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. To the extent such limitations are prohibited by applicable Arizona or federal law, they shall apply to the maximum extent permitted.

9. Indemnification

You agree to defend, indemnify, and hold harmless J Martin Insurance Agency LLC and its members, managers, officers, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without giving effect to any choice-of-law or conflict-of-law rules. The Arizona Uniform Electronic Transactions Act (A.R.S. § 44-7001 et seq.) applies to electronic agreements and transactions conducted through the Site.

10.2 Jurisdiction and Venue

Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to personal jurisdiction and venue in such courts and waive any objection to the laying of venue of any such proceeding in Maricopa County.

10.3 Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us in writing at the address provided in Section 14 and attempt to resolve the dispute informally. We will attempt to resolve any dispute within thirty (30) days of receiving written notice. If the dispute cannot be resolved informally, either party may pursue formal legal remedies as provided herein.

10.4 Waiver of Jury Trial

To the fullest extent permitted by applicable law, both you and J Martin Insurance Agency LLC waive any right to a jury trial in any action or proceeding arising out of or relating to these Terms or your use of the Site.

11. Arizona Consumer Protections

Nothing in these Terms is intended to limit any rights you may have under applicable Arizona consumer protection laws, including:

The Arizona Consumer Fraud Act (A.R.S. § 44-1521 et seq.), which prohibits deceptive or unfair business practices
The Arizona Uniform Electronic Transactions Act (A.R.S. § 44-7001 et seq.), which governs electronic contracts and communications
Arizona insurance laws and regulations, including licensing requirements under A.R.S. Title 20

J Martin Insurance Agency LLC is licensed to conduct insurance business in the State of Arizona as required by law. Licensing information is available upon request or through the Arizona Department of Insurance and Financial Institutions.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. By using the Site, you consent to the data practices described in our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy with respect to privacy matters, the Privacy Policy shall control.

13. Modifications to These Terms

We reserve the right to modify these Terms at any time in our sole discretion. When we make material changes, we will update the Effective Date at the top of this document and, where appropriate, provide additional notice (such as a notice on the Site homepage or via email). Your continued use of the Site after any such changes constitutes your acceptance of the revised Terms.

14.2 Severability

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of J Martin Insurance Agency LLC.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

14.5 Electronic Communications

By using the Site, you consent to receive electronic communications from us. You agree that any agreements, notices, disclosures, or other communications we provide to you electronically satisfy any legal requirement that such communications be in writing, consistent with the Arizona Uniform Electronic Transactions Act (A.R.S. § 44-7001 et seq.).

14.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, government action, or telecommunications failures.
